Pedestrian Right of Way in California:

Many people falsely assume that pedestrians always have the right of way. This is not true, and if a pedestrian is injured while failing to follow the rules of the road, they may not be entitled to compensatory damages. To protect the safety of pedestrians, drivers must follow the following rules:

  • Drivers must always yield to pedestrians in a marked crosswalk. Similarly, they must yield to pedestrians crossing at an intersection even if there is no marked crosswalk.

  • Drivers may not pull around another car that is stopped at a crosswalk.

  • Drivers may only drive on the sidewalk if they are entering or exiting a garage, driveway, or alleyway. When they do cross the sidewalk, they must yield to any pedestrians in the area.

  • Drivers may not stop in a crosswalk. This forces pedestrians to navigate around the vehicle.

If a pedestrian is jaywalking (crossing the street illegally), and a pedestrian accident occurs, the pedestrian may be held liable. Similarly, if a driver gets into a collision with another vehicle while avoiding a jaywalking pedestrian, the pedestrian can be held responsible for the damages.
